Our attorneys are experienced in helping victims of nursing home abuse and neglect recover financial compensation for damages.
Nursing Home Residents Have Rights
Nursing home residents do not give up their rights when they enter a long-term care facility. The Nursing Home Reform Act of 1987 gives residents specific rights, including:
- The right to be free from abuse, mistreatment and neglect
- The right to accommodation of medical, physical, psychological and social needs
- The right to be treated with dignity
The failure to prevent falls is a major problem in nursing homes. About 1,800 people living in U.S. nursing homes die each year from falls, according to the Centers for Disease Control and Prevention. As many as 20 percent of hip fracture patients die within a year of their injury.
Hospital patients as well as nursing home residents must be assessed for their risk of falling when they enter the facility. Facilities that fail to perform a fall risk assessment or to implement a fall prevention plan can be held liable for injuries that occur because of their negligence.
