Video Transcript for 3 Big Mistakes Victims of Personal Injury Make

What are the three big mistakes that victims of personal injury cases make? Hi, I’m Eric Stevenson. And listen up to what I’m about to tell you, because there are three big mistakes that people who are injured through somebody else’s fault make. And so I’m going to tell you what those are real quickly, and then I’m going to go into them.

One is they don’t seek medical care. Two is they don’t talk to a lawyer early on enough in the case. And three, they don’t document the incident.

Right. So what are those issues? Because you don’t want to make those mistakes. The first thing is, if you’re hurt, go to the doctor. It’s hugely important to go to the doctor. You’re not going to get better if you don’t go to the doctor. So go. But also, it helps document that you were injured and that the incident is part of the reason or is the reason that you were hurt. And so it’s important for two reasons. So you’ll get better and so that you can document that the injuries are related to the accident. So often we get in cases and people don’t go to the doctor for a long time because they think they’re going to get better and they don’t. And the insurance companies try to use that against our clients. So be sure to go to the doctor if you’re injured.

Number two, talk to a lawyer. Maybe you don’t have a case, but maybe you do. We don’t charge a consultation fee. Most injury lawyers don’t charge a consultation fee. So it costs nothing to talk to a lawyer to be advised about your rights. The sooner a lawyer recognizes that there’s a personal injury case and can get an investigation started, the better that lawyer is able to protect your rights and bring a claim on your behalf.

Then the third thing is documenting what happened. A lot of times people don’t take pictures. They don’t get somebody to go out and take measurements. And that’s why it’s important maybe to get a lawyer involved. Or if you’re there on the scene and you’ve got your phone and you can take a picture, do that. Have a friend or a family member take pictures as quickly as possible so you can preserve what the accident scene looks like.

And I’m going to give you a fourth one, a bonus that people do that is a huge mistake in personal injury cases, and that’s trying to deal with insurance companies on their own. You need an experienced lawyer to be able to talk to insurance companies. Remember, insurance companies make money by how little they pay out. They collect a lot of premiums and they pay out very little and they want to pay you as little as possible. And so an experienced lawyer will work as hard as they can to be able to bring it to the insurance companies to make sure that you get the compensation that you deserve, if you’re injured.

So if you’re watching this video, you very likely have a question about personal injury claims because you or a family member have been affected. Call us if you’ve got a question. The consultation’s free and the advice given during the consultation is free.

Our number is (850) 444-0000. And we bring it to the insurance companies.

How to Avoid the Three Big Mistakes Victims of Personal Injury Make

Below are three (plus one bonus example) of some of the biggest personal injury victims can make:

  • Not seeking medical treatment quickly enough or at all.
  • Not consulting with an experienced lawyer before speaking to anyone or signing anything.
  • Not documenting the accident.
  • Trying to deal with the insurance company by themselves.

Not Seeking Medical Attention

After an accident, it is essential to get proper medical attention right away. This will provide you with a clear diagnosis of your injuries and allow for proper treatment. Without getting a professional opinion on the extent of your injuries, it will be difficult to assert that the injury was caused by the accident in question.

Undergoing a medical examination after an accident is the only way to determine the extent of your injuries, and therefore make sure you get the compensation you deserve. If you’ve been injured in an accident, contact Stevenson Klotz Injury Lawyers as soon as possible so they can help guide you through the process of seeking medical attention, getting copies of your medical records, and filing a claim.

Not Speaking to a Lawyer

If you are injured in an accident, it is always best to speak to a lawyer before signing any documents or speaking with an insurance company, especially if it’s the other person’s insurance company. Insurance companies may present offers that seem good at first glance but can actually be highly disadvantageous for the victim in the long run. An injury attorney will help you understand your options and ensure that you get the compensation you deserve.

Handling your own personal injury claim can be an overly complex and difficult process to navigate. An experienced attorney can guide accident victims through the ins and outs of the legal system, ensuring they receive all that is owed to them. Failing To Gather Evidence and Document the Accident

Gathering evidence after an accident can be crucial in proving your case and obtaining compensation for your damages. Take pictures of the scene of the accident, secure contact information from any potential witnesses, and keep documentation of all costs related to medical bills or other expenses due to the incident. It’s important that victims document any pictures or videos of the incident, take down witness statements if available, obtain copies of any police reports filed, and keep track of all documents related to their injury.

More Mistakes You Should Avoid If You’ve Been Injured

Accepting a settlement from insurance companies without consulting a lawyer

Insurance companies are often eager to offer a settlement that’s far less than what you could get if you went through the legal process. To accept an offer or give a recorded statement to the defendant’s insurance company without consulting a lawyer first could greatly hinder your ability to recover compensation. An experienced personal injury lawyer can help you maximize your compensation and protect your rights.

Going it alone

One of the biggest mistakes injury victims can make is attempting to handle their claim without legal representation. Navigating the world of personal injury claims can be difficult and stressful. The process of filing a personal injury claim is complex and filled with potential pitfalls. Having an experienced attorney on your side can ensure that your rights are protected throughout the entire process.

Delaying filing a claim

It is important to file a claim as soon as possible after an injury occurs. Every state has certain statutes of limitation which set a maximum amount of time that claimants have to legally take action for their injuries. If these deadlines pass, victims may lose their right to pursue legal action against those who caused their injuries. In the state of Florida, victims injured because of someone else’s negligence have up to two years to file a personal injury claim.

These strict deadlines for filing a personal injury lawsuit are important, so contact an attorney as soon as possible if you have been injured due to another person’s negligence. Don’t wait too long, or you may be barred from seeking financial compensation for your injuries.
